The European Court of Human Rights has begun considering behind closed doors the complaint by former prime minister and leader of the Batkivschyna All-Ukrainian Association party Yulia Tymoshenko that Ukrainian courts violated her rights to a fair trial during consideration of her appeal against the criminal case that the Prosecutor-General's Office filed against her in connection with the conclusion of gas contracts between Ukraine and Russia in 2009.Press service of the Batkivschyna party announced this in a statement.The court began public hearing of Tymoshenko's complaint in Strasbourg (France) at 14:30, local time.the government's authorized representative at the European Court of Human Rights Nazar Kulchytskyi represented the defendant (Ukraine) while Valentyn Telychenko and Parliamentary Deputy Serhii Vlasenko and represented Tymoshenko during the public hearing.According to the press service of the European Court of Human Rights, the former prime minister's complaints are being considered by eight judges: presiding judge Dean Spielmann (Luxembourg), Mark Villiger (Liechtenstein), Karel Jungwiert (the Czech Republic), Bostjan M. Zupancic (Slovenia), Hanna Yudkivska (Ukraine), Angelika Nu?berger (Germany), Andre Potocki (France), and substitute judge Ann Power-Forde (Ireland).A decision will be made at a later stage.As Ukrainian News earlier reported, the European Court of Human Rights asked the Ukrainian authorities on March 15 to ensure that Tymoshenko was receiving adequate medical treatment in an appropriate medical institution.Tymoshenko's defense team filed a supplement to the earlier complaint it filed with the European court in May.The European Court of Human Rights decided on December 14, 2011, to accelerated consideration of Tymoshenko's complaint.In her complaint, Tymoshenko said that her pre-trial detention and the criminal case against her in connection with the gas contracts with Russia were politically motivated.
Министерство юстиции получило последние данные от Европейского суда по правам человека, согласно которым более половины жалоб против Украины связаны с событиями в Крыму и на Донбассе.
Так, на сегодняшний день в ЕСПЧ находятся 4226 таких дел. Из них 257 подано против РФ, 908 – одновременно против Украины и России, а против Украины – почти 3000.
55 дел связаны с событиями на Донбассе в 2014 — 2015 годах. Преимущественно это жалобы украинских добровольцев, которые попали в плен во время Иловайской трагедии.
Есть также 4 дела, поданные родственниками лиц, погибших при падении самолета рейса МН17 в июле 2014 года. Заявители проживают в Германии. Они обвиняют Украину в том, что она позволила гражданским самолетам пролетать над своей территорией.
Отметим, что в ЕСПЧ есть такая процедура, как межгосударственная жалоба в связи с нарушением прав человека. Их за всю историю суда было 23. Теперь 5 из них – наши против России.
